What is your role in the packaging lifecycle?

The PPWR applies to a broad range of entities involved in the lifecycle of packaging. Do one or more of the below notions apply to you?

Note: A Producer is any person or entity that places (i.e., makes available for the first time) packaging and/or packaged products on the market within the EU. This includes: (i) entities established in the EU or in third countries that manufacture, import, or distributes packaging and/or packaged products into the EU market; or (ii) if there is no producer based on point (i) above, entities established in the EU that unpack packaged products without being the end-user (i.e., they will make them further available on the market in the same form). For example: a company that imports bottled beverages from outside the EU and sells them within EU member states is considered a producer under the PPWR. Note: A Manufacturer is a person or entity engaged in the manufacture of packaging and/or packaged products. For example: an economic operator that makes plastic containers for food products is a manufacturer. The company produces the packaging that will be used to contain and protect the food items. A company that fills glass packaging with a cosmetic product and places it on the EU market is also considered a manufacturer. In case of doubt, please consult the legal definition of this term

Note: An  Importer is a person or entity that brings packaging and/or packaged products from outside the EU into the EU market. For example: a business that imports electronics from Asia to Europe, where the electronics are packaged, is considered an importer. In case of doubt, please consult the legal definition of this term

Note: A Distributor is a person or entity in the supply chain (other than the manufacturer or importer), that makes packaging available on the market in the EU. For example: an operator that supplies packaged products to various retail stores acts as a distributor. In case of doubt, please consult the legal definition of this term

Note: A Final distributor is the last point of the supply chain, which delivers to the end user (i) packaged products (including through reuse); and/or (ii) products that can be purchased through refill. For example: a retail store, supermarket, or online retailer. In case of doubt, please consult the legal definition of this term

Note: A Supplier of packaging is any entity which provides packaging or packaging materials to manufacturers. For example: a company which produces glass bottles for a beverage company. In case of doubt, please consult the legal definition of this term

Note: An Authorised representative is a person or entity established in the EU and mandated by manufacturers to act on their behalf in ensuring compliance with the PPWR requirements. For example, a non-EU company appointing an EU entity to handle regulatory compliance for its packaging. In case of doubt, please consult the legal definition of this term

Note: An Authorised representative for the extended producer responsibility for the extended producer responsibility is a person or entity established in the EU and mandated by producers to act on their behalf in ensuring compliance with the PPWR requirements on extended producer responsibility (Chapter VIII PPWR). In case of doubt, please consult the legal definition of this term

Note: A Producer responsibility organisation financially and/or operationally organises the fulfilment of extended producer responsibility obligations on behalf of several producers. In case of doubt, please consult the legal definition of this term

Note: An Online platform is a digital marketplace where sellers can list and sell their products to consumers. For example, an online website where third parties can sell second-hand products to each other. In case of doubt, please consult the legal definition of this term

Note: A provider of fulfilment services offers at least two of the following services: warehousing, packaging, addressing and dispatching, without having ownership of the products involved. This excludes postal services (as defined in point 1 of Article 2 of Directive 97/67/EC), parcel delivery services (as defined in point 2 of Article 2 of Regulation (EU) 2018/644), and any other postal services or freight transport services. In case of doubt, please consult the legal definition of “fulfilment service provider”, which features under Article 3(11) of Regulation (EU) 2019/1020 on market surveillance and compliance of products and amending Directive 2004/42/EC and Regulations (EC) No 765/2008 and (EU) No 305/2011.

Note: A B2B company sells to other professionals. For example: a supplier selling beverages to a retailer.

Note: A B2C business sells to consumers. For example: a retailer selling beverages directly to the final consumers.
